Video Call Santa

These Terms of Service (the “Terms”) govern your access to and use of the Video Call Santa mobile application in both its iOS and Android versions, the official Video Call Santa website at videocallsanta.com, and related features, content, and services that link to these Terms (collectively, the “Service”). The Service is provided by Dualverse, Inc. (“Dualverse,” “we,” “us,” or “our”).
If you are an adult, by downloading, accessing, or using the Service, you agree to these Terms. If you allow a child to use the Service, you agree to these Terms on your own behalf and are responsible for supervising the child’s use. If you do not agree to these Terms, do not use the Service.
Our Privacy Policy explains how information is handled in connection with the Service.
1. About the Service
Video Call Santa is a family entertainment service that creates simulated Santa-themed experiences. Depending on the platform, device, region, and version, features may include:
- simulated Santa video calls using pre-recorded content;
- one or more Santa performances available in the installed version;
- immediate simulated calls on iOS and Android;
- on iOS, the option to reserve a call for a later time and to configure an incoming or outgoing call experience;
- episodes and name personalization;
- locally stored reaction recordings or rendered videos;
- a Parents Only section;
- advertising and optional in-app purchases.
The simulated video calls are for entertainment purposes only. They use pre-recorded content and are not live video calls. No live Santa operator or other person is watching, listening to, or communicating with the user through the simulated call. The pre-recorded Santa does not actually understand or respond to the user’s answers.
2. Adults, Children, and Family Use
The Service is designed for family entertainment and includes content intended to be enjoyed by children under adult supervision. If you allow a child to use the Service, you agree to these Terms on your own behalf and are responsible for choosing and configuring the experience and supervising the child’s use.
Children may not independently make purchases, change parent-controlled settings, submit unnecessary personal information, or save, export, or publicly share recordings. The supervising adult is responsible for:
- deciding whether the Service is appropriate for the child;
- controlling device permissions, settings, and purchases;
- supervising name requests;
- obtaining any permission required to record a person; and
- deciding whether, where, and with whom a recording may be shared.
Use your device’s parental controls, purchase authentication, and other family-safety settings where appropriate.
3. Parents Only Section
The Service may include a Parents Only section intended for adults. Depending on the platform and version, this section may provide access to settings, recordings, personalization, purchases, and other parent-controlled features. The iOS version may also provide access to call reservations. Call reservations are not currently available in the Android version.
Access may be protected by a user-created passcode and/or supported biometric authentication, such as Face ID, Touch ID, or Android biometrics. If you forget your passcode, Dualverse cannot retrieve it for you. To reset it, enter an incorrect passcode seven times in the App and follow the reset instructions provided there.
The Parents Only section is an additional convenience, not a guarantee that a child or another person cannot access the device or its contents. You remain responsible for securing your device and enabling platform-level purchase authentication and parental controls.
4. License to Use the Service
Subject to these Terms and the applicable app-store rules, Dualverse grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to download and use the Service for lawful, non-commercial family entertainment.
You may not:
- copy, reproduce, modify, distribute, sell, lease, sublicense, or commercially exploit any part of the Service except as permitted by law;
- reverse engineer, decompile, or attempt to extract source code except to the extent applicable law expressly permits it;
- bypass access controls, security features, purchase systems, or technical restrictions;
- interfere with the operation, security, or integrity of the Service;
- use the Service for unlawful, fraudulent, abusive, harmful, or misleading purposes; or
- misuse personalization, recording, sharing, or purchase-related features.
5. Features, Compatibility, and Availability
Features, Santa performances, names, episodes, purchase options, advertisements, and restoration methods may vary by platform, device, operating system, region, language, and app version. A feature available on iOS may not be available or identical on Android, and vice versa. As of the date above, call reservations and scheduled-call functions are available on iOS but are not available on Android.
We may update, improve, replace, suspend, or discontinue features or content for legal, security, technical, licensing, operational, or product reasons. We do not guarantee continued compatibility with every device or operating-system version.
If a change materially prevents access to paid digital content, we will provide any remedy required by applicable law. Nothing in this section limits mandatory consumer rights.
6. Name Personalization and Name Requests
The Service may allow an adult to select an available name to personalize a Santa experience. If a name is unavailable, the Service may allow a Request Name submission.
When submitting a request, you agree to:
- submit only the first name or simple name entry needed for the feature;
- avoid full names, phone numbers, addresses, email addresses, school names, account credentials, medical information, or other unnecessary or sensitive information; and
- submit information only when you have authority to do so.
Requested names may be stored and used to review requests, improve the name library, and prepare future updates, as further described in our Privacy Policy. We do not guarantee that a requested name will be recorded, added, or made available by any particular date.
You grant Dualverse a worldwide, royalty-free, non-exclusive license to use name requests, suggestions, ideas, and other feedback you voluntarily submit for the purpose of operating, supporting, and improving the Service. This license does not give us ownership of your personal information, which remains subject to our Privacy Policy and applicable law.
7. Reaction Recordings and Local Storage
When enabled and permitted by your device settings, the Service may use the camera and microphone to show the user on the call screen and create a reaction recording or rendered video.
The reaction-recording feature stores those files locally on the device. Dualverse does not upload or store reaction recordings on its servers through this feature and cannot view, retrieve, or recover them. If your device or photo library uses iCloud, Google backup, or another backup or synchronization service, that third-party service may separately copy or process the files under its own terms and privacy policy.
Local recordings may be permanently lost if you delete the Service, clear app data, reset or replace the device, remove local files, or lose access to the device. You are responsible for saving and preserving any recording you want to keep.
Before recording, you must obtain any consent required from the person being recorded and, when applicable, that person’s parent or legal guardian. Do not use the recording feature where recording is prohibited.
8. Saving and Sharing Recordings
The Service may allow an adult to save or share a recording through the device’s photo library, share sheet, messaging tools, social media, cloud services, or other third-party services. Dualverse does not control what those services do with shared content.
You are responsible for any content you save, export, publish, or share, including child-related content. Before sharing, make sure you have all required permissions, consider whether the child could be identified or located, and review the audience and privacy settings of the receiving service.
9. In-App Purchases
The Service may offer optional in-app purchases. Prices, product descriptions, included benefits, and any important limitations will be shown in the Service or by the applicable app marketplace before purchase. Prices may vary by platform, region, currency, and tax rules.
Payments are processed by the Apple App Store or Google Play, not directly by Dualverse. Store account, billing, and payment information is handled under the applicable platform’s terms and policies.
Unless the purchase screen clearly states otherwise, current purchases for names, episodes, premium features, or bundles are intended to be one-time, non-consumable purchases and do not renew automatically. The purchase screen and applicable app marketplace identify what each purchase includes.
Only an adult may authorize a purchase. You are responsible for securing the app-store account and enabling purchase authentication on the device.
10. Purchase Restoration
Permanent, non-consumable purchases may be restorable through the applicable app store when you use the same platform account that made the purchase and when the product remains supported. Purchases do not automatically transfer between Apple and Google platforms or between different store accounts.
If restoration does not work, contact contact@dualverse.com and include your platform, device type, app version, purchase receipt or order number if available, and a description of the problem. We may use a redeem code or another reasonable method to help restore an eligible permanent purchase. Any code may be subject to the redemption deadline and platform restrictions stated when it is provided.
Restoration remains subject to app-store systems, account verification, technical compatibility, fraud prevention, and applicable law. This section does not limit any legal right or remedy you may have for paid content.
11. Refunds, Billing Issues, and Taxes
Refund eligibility and processing are governed by the applicable app marketplace’s policies and by mandatory law in your location. Apple generally handles refund requests for App Store purchases. Google Play may process eligible Google Play refunds, and you may also contact Dualverse regarding an Android purchase issue.
Nothing in these Terms removes any right to a refund, repair, replacement, price reduction, or other remedy that applicable law provides for defective, misdescribed, or unavailable digital content. If a paid feature does not work as described, contact us so we can investigate and help resolve the issue.
Displayed prices may include or exclude taxes depending on the marketplace and location. You are responsible for any taxes the platform properly charges in connection with your purchase.
12. Advertising
The free version of the Service may display advertisements, including ads provided by third parties such as Google AdMob. Advertising availability and format may vary by region, platform, consent choices, and app version.
Third-party advertising services may process information under their own terms and privacy practices, subject to applicable law and platform requirements. More information is provided in our Privacy Policy. Any ad-removal benefit applies as described on the applicable purchase screen.
13. Intellectual Property
The Service, including its software, design, text, graphics, interfaces, audio, video, Santa performances, characters, episodes, trademarks, logos, and other content, is owned by Dualverse or its licensors and is protected by applicable intellectual-property laws.
Except for the limited license in Section 4, these Terms do not grant you any ownership or other right in the Service or its content. Third-party names, marks, and services remain the property of their respective owners.
14. Acceptable Use
You agree not to use the Service:
- in violation of applicable law, regulation, or another person’s rights;
- to record, upload, publish, or share content without required permission;
- to exploit, endanger, harass, impersonate, or harm a child or any other person;
- to submit illegal, threatening, abusive, sexually exploitative, hateful, defamatory, or otherwise harmful material;
- to probe, attack, disrupt, overload, or gain unauthorized access to the Service or related systems;
- to automate requests, scrape content, circumvent limits, or commit purchase or refund fraud;
- to introduce malware or other harmful code; or
- to use the Service or its content for commercial exploitation without our written permission.
15. Third-Party Platforms, Services, and Links
The Service may interact with Apple, Google, advertising providers, cloud services, social platforms, device features, and other third-party services. We do not control third-party services, and their own terms and privacy policies govern your use of them.
Your download and use of the iOS version may also be subject to Apple’s applicable App Store terms and standard end-user license agreement. Your download and use of the Android version may also be subject to Google Play’s applicable terms. Apple and Google are not parties to these Terms between you and Dualverse and are not responsible for providing support for the Service except as required by their own terms or applicable law.
16. Service Updates, Changes, and Suspension
We may provide updates that are necessary for security, compatibility, legal compliance, performance, or continued operation. Some features may not work correctly if you do not install a required update.
We may suspend or limit access to all or part of the Service when reasonably necessary for maintenance, security, legal compliance, protection of users, prevention of fraud or abuse, or events outside our reasonable control. When practical, we will try to minimize disruption.
17. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Service is provided “as is” and “as available.” Dualverse does not promise that the Service will always be available, uninterrupted, error-free, compatible with every device, or free from every harmful component, or that every name request, purchase restoration, or feature will meet your expectations.
To the fullest extent permitted by law, Dualverse disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, these exclusions apply only to the extent permitted by law. Nothing in these Terms excludes any statutory guarantee, warranty, or consumer remedy that cannot lawfully be excluded.
18. Limitation of Liability
To the fullest extent permitted by applicable law, Dualverse and its directors, officers, employees, affiliates, licensors, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business, goodwill, data, recordings, or other intangible losses, arising from or related to the Service or these Terms.
To the fullest extent permitted by applicable law, Dualverse’s total aggregate liability for all claims arising from or relating to the Service or these Terms will not exceed the amount you paid through the applicable app marketplace for the Service or the relevant in-app purchase during the 12 months before the event giving rise to the claim.
These limitations do not apply to liability that cannot lawfully be excluded or limited, including, where applicable, liability for fraud or fraudulent misrepresentation, willful misconduct, gross negligence, death or personal injury caused by negligence, or violation of mandatory consumer rights.
19. Indemnity for Unlawful Misuse
To the extent permitted by applicable law, an adult user agrees to indemnify and hold harmless Dualverse and its affiliates, officers, directors, employees, and contractors from third-party claims, damages, and reasonable costs arising directly from the adult user’s:
- deliberate or unlawful misuse of the Service;
- material breach of these Terms;
- infringement of another person’s intellectual-property, privacy, publicity, or other rights; or
- recording, publication, or sharing of content without required permission.
This section does not require indemnification for Dualverse’s own negligence, misconduct, or violation of law, and it does not apply to a child user.
20. Suspension and Termination
You may stop using the Service at any time and may uninstall the app.
We may suspend or terminate access to a feature if we reasonably believe that an adult user materially violated these Terms; created a legal, safety, security, or technical risk; manipulated purchases; or used the Service to harm another person. Where reasonably possible, we will limit the action to the affected feature or conduct.
Termination does not remove rights or obligations that arose before termination. Sections that by their nature should continue will survive, including those concerning purchases, intellectual property, disclaimers, liability, indemnity, governing law, and disputes.
21. Changes to These Terms
We may update these Terms to reflect changes in the Service, purchases, laws, platform rules, safety practices, or business operations. When we make a material change, we will provide reasonable notice through the Service, our website, the applicable app-store listing, or another appropriate method and will update the date above.
Changes apply prospectively from the date the revised Terms become effective. If applicable law requires affirmative consent to a material change, we will obtain it as required. If you do not agree to revised Terms, stop using the Service.
22. Governing Law and Consumer Rights
These Terms are governed by the laws of the Republic of Korea, without regard to conflict-of-laws principles. However, if you are a consumer, you retain the benefit of any mandatory consumer-protection law and any right to bring a claim in a competent local court that cannot lawfully be waived by contract.
Before starting a formal dispute, you and Dualverse are encouraged to contact each other and make a reasonable good-faith effort to resolve the matter informally. This does not prevent either party from seeking urgent relief or exercising a right that cannot be limited by contract.
23. General Terms
If any provision of these Terms is found unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights or obligations under these Terms without our consent. We may transfer these Terms as part of a merger, reorganization, financing, sale of assets, or transfer of the Service, subject to applicable law.
These Terms, together with any purchase disclosures and applicable platform terms, form the agreement concerning your use of the Service. If a translated version conflicts with the English version, the English version controls to the extent permitted by applicable law, unless the translated version expressly states otherwise.
