Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Video Call Santa mobile application, website, and related services provided by Dualverse, Inc. (“Dualverse,” “we,” “us,” or “our”).
By downloading, accessing, or using Video Call Santa, you agree to these Terms. If you do not agree, please do not use the App.
1. About the App
Video Call Santa is a family entertainment app that offers simulated Santa-themed video call experiences, personalization features, scheduling features, and locally stored reaction video recordings.
Video Call Santa is for entertainment purposes only. All Santa calls, conversations, and interactions in the App are simulated and pre-recorded. There is no live Santa operator, no live video call, and no real-time communication with a live person through the App.
2. Eligibility and Family Use
The App is intended for general audiences and family use. Parental supervision is recommended when children use the App.
If you allow a child to use the App, you are responsible for supervising the child’s use of the App, including use of recordings, sharing features, settings, and in-app purchases.
3. Parents Only Section
The App includes a Parents Only section intended for adult use. This section may provide access to features such as settings, recordings, reservations, and purchase-related functions.
Access to the Parents Only section may require:
- a numeric passcode set by the user, and/or
- supported biometric authentication, such as Face ID, Touch ID, or Android biometrics
If you forget your passcode, Dualverse cannot retrieve it for you. To reset it, enter an incorrect passcode seven times and follow the reset instructions provided in the App.
4. License to Use the App
Subject to these Terms, Dualverse grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial use.
You may not:
- copy, reproduce, modify, distribute, sell, lease, sublicense, or commercially exploit any part of the App except as permitted by law
- reverse engineer, decompile, or attempt to extract source code from the App except where prohibited by law
- use the App for unlawful, harmful, fraudulent, abusive, or misleading purposes
- interfere with the operation, security, or integrity of the App
- misuse any personalization, recording, sharing, or purchase-related features
5. App Features and Availability
Features may vary by platform, device, region, and app version.
For example:
- some Santa personas may be available only on certain platforms
- some purchase options or upgrade paths may be available only on certain platforms
- restoration behavior may differ between iOS and Android
We may change, suspend, remove, discontinue, or update any feature, content, or functionality of the App at any time.
6. Name Personalization and Name Requests
The App may allow users to personalize the experience with available names.
If a requested name is not available, the App may offer a Request Name feature. When you use this feature, you agree:
- to submit only the first name or simple name entry needed for the feature
- not to submit full names, phone numbers, addresses, email addresses, or other unnecessary personal information
- that requested names may be stored and used by Dualverse for future App updates and name library improvements
We do not guarantee that any requested name will be added or that it will become available within any particular time.
If you submit a name request, suggestion, idea, or other feedback, you agree that Dualverse may use it to operate, improve, and update the App without compensation or other obligation to you.
7. Recordings and Local Storage
The App may create reaction recordings or rendered videos during use.
These recordings are stored locally on your device only. Dualverse does not store these recordings on its servers and cannot recover them if they are lost or deleted.
You are solely responsible for saving, exporting, backing up, and preserving any recordings you want to keep. If you delete the App, reinstall it, clear app data, reset your device, or otherwise remove local files, your recordings may be permanently lost.
To the fullest extent permitted by law, Dualverse is not responsible for lost, erased, or unrecoverable recordings stored locally on your device.
8. Sharing Content
The App may allow you to save or share recordings using your device or third-party platforms.
You are solely responsible for any content you save or share, including making sure you have any necessary permissions and that your use complies with applicable law and platform rules.
9. In-App Purchases
The App may offer optional in-app purchases, including premium features, episodes, names, and bundled packages.
Prices are displayed in the App and/or the applicable app marketplace at the time of purchase, may vary by region, and may change from time to time without notice. Payments are processed by the applicable platform provider, such as Apple App Store or Google Play, and may be subject to that provider’s additional terms and policies.
Unless otherwise stated, in-app purchases are intended to be non-consumable.
Any ad removal, premium access, purchase restoration, or related benefits are provided subject to platform limitations, compatibility, and the continued availability of the relevant features.
10. Purchase Restoration
iOS
On iOS, purchases are intended to be restorable through Apple’s systems, subject to Apple’s platform rules and account conditions.
Android
On Android, purchase restoration may not always work automatically after deleting and reinstalling the App. If this occurs, you may contact us at contact@dualverse.com and provide proof of purchase. If appropriate, we may provide a redeem code or other restoration assistance.
Redeem codes or similar restoration methods may:
- expire after a limited time
- require redemption within the period we specify
- be subject to platform limitations
- be unavailable if lost or expired
We do not guarantee restoration in all circumstances where platform, device, account, or technical limitations prevent it.
11. Refunds
Except where required by applicable law, or where we determine that an issue was caused by us, purchases are generally non-refundable.
For iOS purchases, refund requests are generally handled by Apple under Apple’s policies. For Android-related purchase issues, you may contact contact@dualverse.com.
12. Advertising
The App may display advertisements, including advertisements served by third-party providers such as Google AdMob. Your interactions with ads and related services may be subject to those third parties’ terms, privacy policies, and technical practices.
13. Intellectual Property
The App, including its software, design, text, graphics, audio, video, characters, episodes, trademarks, logos, and other content, is owned by Dualverse or its licensors and is protected by applicable intellectual property laws.
These Terms do not transfer any ownership rights to you except for the limited license expressly granted above.
14. Third-Party Services and Links
The App or website may contain links to or integrations with third-party services, platforms, or tools. We do not control and are not responsible for the content, policies, practices, or availability of any third-party services.
Your use of third-party services is governed by their own terms and policies.
15. Acceptable Use
You agree not to use the App:
- in violation of any applicable law or regulation
- to infringe the rights of others
- to attempt unauthorized access to any system, service, or data
- to interfere with or disrupt the App or its related systems
- to upload, transmit, or share content that is unlawful, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable
- in any way that could harm children, other users, or the integrity of the App experience
16. Disclaimer of Warranties
To the fullest extent permitted by law, the App is provided on an “as is” and “as available” basis.
Dualverse does not guarantee that:
- the App will always be available, uninterrupted, or error-free
- all features will continue to be offered
- all requested names will be added
- all purchases or restorations will work perfectly across all devices, platforms, and versions
- the App will be compatible with all devices or operating systems
To the fullest extent permitted by law, Dualverse disclaims all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
17. Limitation of Liability
To the fullest extent permitted by law, Dualverse, Inc. and its directors, officers, employees, affiliates, licensors, contractors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, business, goodwill, data, recordings, or other intangible losses arising out of or related to your use of or inability to use the App.
To the fullest extent permitted by law, the total liability of Dualverse for any claim arising out of or relating to the App or these Terms will not exceed the amount you paid, if any, for the App or the relevant in-app purchase during the twelve-month period before the claim arose.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
18. Indemnity
To the fullest extent permitted by law, you agree to indemnify and hold harmless Dualverse, Inc. and its affiliates, officers, directors, employees, contractors, licensors, and service providers from and against claims, liabilities, damages, losses, and expenses arising out of or related to:
- your use of the App
- your violation of these Terms
- your violation of applicable law
- content you save, share, or distribute through or from the App
19. Suspension and Termination
We may suspend or terminate your access to the App or any feature at any time if we reasonably believe:
- you violated these Terms
- your use creates legal, technical, or security risk
- suspension or termination is necessary for maintenance, operational, or legal reasons
You may stop using the App at any time by uninstalling it.
20. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we may provide notice by updating the “Last Updated” date, through the App, on our website, or by other reasonable means.
Your continued use of the App after the updated Terms become effective means you accept the revised Terms.
21. Governing Law
These Terms are governed by the laws of the Republic of Korea, without regard to conflict of laws principles, except to the extent that mandatory consumer protection laws in your jurisdiction apply.
